2 · Scope and precedence
Which terms apply.
These general terms apply to use of the website, direct enquiries, tourism services booked with White Houses Tours and wine-shop orders. A product page, booking screen, written proposal, supplier ticket condition or external-platform condition may contain specific terms for the relevant purchase.
In the event of inconsistency, mandatory consumer law prevails first, followed by the specific terms clearly disclosed before the booking or purchase, and then these general terms. Nothing here removes a right that cannot lawfully be excluded.
Where a combination of travel services legally qualifies as a package or linked travel arrangement, the mandatory pre-contract information, insolvency protection and traveller remedies required by the applicable package-travel rules also apply.
3 · Website and enquiries
Information before a contract.
We aim to keep descriptions, schedules, prices, images and availability accurate. Availability can change, and request-only experiences are not fixed products until a written proposal is issued. If a material error is identified before confirmation, we will correct it and ask whether you wish to continue.
An enquiry form asks White Houses Tours to review a possible service. It is not a reservation, ticket hold or promise of availability. Do not make non-refundable travel arrangements until you have received the required written confirmation.
4 · Booking and confirmation
When a booking exists.
A direct online booking is confirmed when the payment or required deposit has been accepted and a confirmation is issued to the email address supplied. A private or request-only service is confirmed according to the acceptance and payment steps stated in the written proposal.
You must check the confirmation promptly and tell us about any error in the date, guest count, contact details, pickup or selected service. A booking may be made only by an adult with authority to act for everyone included in it.
5 · Prices and payment
Clear total before payment.
Prices are shown in euros. The final amount, applicable taxes, delivery charge, supplier ticket cost and any optional service must be displayed or confirmed before payment. Payment methods are those presented in the relevant checkout, payment link or written proposal.
White Houses Tours does not store full card details. Card payments are processed by the payment provider. A payment may be refused or reviewed where fraud, misuse, a pricing error or an age-verification issue is reasonably suspected.
6 · Regular experiences
Direct regular bookings.
Regular tours and tastings booked directly through White Houses Tours are paid in full at booking unless the booking screen states otherwise. The current standard direct-booking cancellation policy is free cancellation up to 24 hours before the scheduled start time.
A cancellation received within the final 24 hours, late arrival that prevents participation, or a no-show is normally non-refundable, subject to mandatory law and any more favourable product-specific term shown before payment.
7 · Private and request-only services
The proposal controls the practical details.
Private tours, business events, the Málaga Tapas Tour, Caminito del Rey and other request-only services depend on availability and a written proposal. The proposal identifies the service, date, group size, start area, duration or timing, inclusions, exclusions, price, payment schedule and cancellation conditions.
For the standard WHT private-tour process, a €100 group deposit is used to block the date. It is fully refundable when cancellation is received at least 7 days before the scheduled start time and non-refundable within the final 7 days. Approximately 3 days before the service, the final guest count and practical requirements are reconfirmed and the remaining balance is requested, unless the proposal states another lawful arrangement.
8 · Supplier tickets and restricted access
Rules outside WHT’s control.
Some services require tickets, access slots, transport, venues or guides controlled by an independent supplier. Their conditions are disclosed or incorporated into the proposal before payment where relevant. Supplier tickets may be non-changeable or non-refundable after issue.
For Caminito del Rey, official access availability, identity requirements, minimum age, safety rules, closure decisions and official ticket remedies are determined by the managing entity. White Houses Tours does not override those rules.
9 · Changes and cancellations
If plans change.
Changes requested by the traveller
We will try to accommodate a requested change, but it depends on availability and may alter the price or incur a documented supplier cost. A change is effective only when confirmed in writing.
Changes or cancellation by White Houses Tours
Safety, weather, official closure, illness, transport disruption or another unavoidable circumstance may require a reasonable change. We will explain the material change and, depending on the contract and applicable law, offer an appropriate alternative, price adjustment or refund. If White Houses Tours cancels a service and no suitable alternative is accepted, amounts due for the cancelled service will be refunded as required by law.
10 · Traveller responsibilities
Accurate details and reasonable conduct.
- Provide accurate contact, guest, age and booking information.
- Read the confirmation, meeting point, timing and practical instructions.
- Arrive at the stated place with sufficient time.
- Follow lawful instructions from guides, hosts, drivers, venues and official-site staff.
- Treat local partners, other guests, animals, property and the natural environment respectfully.
- Do not attend while impaired in a way that creates a safety risk.
A person may be refused participation or asked to leave where their conduct creates a material safety risk, seriously disrupts the service or breaches an official rule. Any refund will depend on the circumstances and applicable law.
11 · Safety, accessibility and dietary information
Tell us what is necessary.
Route conditions, accessibility and food options vary by experience and supplier. Ask before booking when a guest has a mobility, accessibility, allergy, intolerance or other requirement that may affect safe participation.
Only the minimum necessary information should be provided. A requested adaptation is not guaranteed until confirmed. Where participation would create a material safety risk that cannot reasonably be mitigated, we will explain the issue and discuss available alternatives.
Alcohol is served only to adults and may be refused where required by law or responsible-service considerations.
12 · Responsibility and liability
Rights are not waived.
White Houses Tours is responsible for performing its contractual obligations with reasonable care and in accordance with applicable law. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or mandatory consumer remedies.
We are not responsible for loss caused exclusively by the traveller’s breach, an unrelated third party, or unavoidable and extraordinary circumstances beyond reasonable control, except where the law provides otherwise. Claims for foreseeable direct loss are assessed under the contract and applicable law; remote or purely indirect business losses are not recoverable where lawfully excluded.
13 · Wine shop
Bottled wine orders.
Age
The buyer and recipient must be at least 18 and legally permitted to purchase and receive alcohol. Age verification or an adult signature may be required.
Products and vintages
Descriptions are prepared carefully, but vintage, label or packaging may change where clearly disclosed and without reducing the consumer’s statutory rights.
Delivery and risk
Available destinations, taxes and shipping costs are shown before payment. Delivery dates are estimates unless expressly guaranteed. Risk passes when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession, unless the consumer independently selected a carrier not offered by us.
International orders
Import rules, excise duties, customs charges and local restrictions may apply outside Spain or the EU. The allocation of those costs and responsibilities will be shown before purchase where applicable.
Damage or incorrect goods
Contact us as soon as reasonably possible with the order details and photographs of the parcel, packaging, labels and damage. A request for prompt evidence does not remove statutory conformity rights.
14 · Withdrawal rights
Different rules for dated leisure services and goods.
Tours, tastings and dated leisure services
The statutory 14-day distance-contract withdrawal right does not generally apply to leisure-related services that provide for a specific date or period of performance. The cancellation policy disclosed for the booking therefore applies, without limiting any other mandatory remedy.
Wine-shop goods
An EU/EEA consumer generally has 14 days from physical receipt to communicate withdrawal from an online purchase of goods, subject to statutory exceptions. The goods must then be returned within 14 days. The consumer bears the direct return cost unless we agreed otherwise or failed to provide the required information.
A valid withdrawal is refunded using the original payment method, including the least expensive standard outbound delivery option where legally required. We may withhold the refund until the goods are received or proof of return is supplied. The consumer is responsible only for diminished value caused by handling beyond what is necessary to establish the nature and characteristics of the goods.

15 · External booking platforms
Bookings made elsewhere.
A booking made through Viator, GetYourGuide, Airbnb Experiences or another marketplace is also subject to that platform’s payment, cancellation and customer-service conditions. Contact the platform first for changes that its system controls. Mandatory rights remain unaffected.
16 · Intellectual property
Website content.
Unless another owner is identified, the website’s original text, branding, layout, graphics and software are owned by or licensed to White Houses Tours and protected by applicable intellectual-property law. Personal, non-commercial viewing is permitted. Reproduction, scraping for republication, resale or misleading use requires prior written permission unless law provides otherwise.
17 · Complaints and disputes
Start by writing to us.
Send a complaint to info@whitehousestours.com with the booking or order reference, a clear description and the remedy requested. We will acknowledge and review it using the information reasonably needed.
Official Andalusian consumer complaint forms are available as required by law. They may be requested free of charge through our postal or electronic contact details. Guidance is available from the Junta de Andalucía consumer complaints service. Where applicable, our response will state whether mediation or consumer arbitration is accepted for the particular dispute. We do not state that White Houses Tours is generally bound to a specific ADR body unless this has been expressly confirmed.
The former EU Online Dispute Resolution platform stopped accepting complaints on 20 March 2025 and was subsequently discontinued. Consumers may consult the European Commission’s current consumer-redress information and the competent Spanish or regional consumer authorities.
18 · Privacy
Personal data.
Personal data is processed for enquiries, bookings, service delivery, payments, legal compliance, customer support and other purposes explained in the Privacy and Cookie Policy. Do not send unnecessary sensitive information.
19 · Law and jurisdiction
Spanish law, without removing consumer protection.
These terms are governed by Spanish law. Consumers retain any mandatory protection of the country in which they habitually reside when applicable, and disputes may be brought before the courts determined by mandatory jurisdiction rules. No clause here forces a consumer to waive a court or remedy available under mandatory law.
For a contract made exclusively in the course of business, and only where legally valid and not otherwise agreed in writing, the courts corresponding to the service provider’s domicile will have jurisdiction.
20 · Updates and contact
The version that applies.
The terms applicable to a booking or purchase are those made available before that contract was concluded, together with the specific confirmation or proposal. We may update this public page for future contracts when services, suppliers or law change.
